CARY – A Cary woman injured when her deck collapsed has filed a lawsuit against Town and Country Homes and a subcontractor.
Marisa Costello broke several bones when the 12-foot deck off her kitchen collapsed this month.
In a lawsuit filed last week, Costello’s attorney Francis Patrick Murphy alleged that Town and Country Homes failed to properly secure the deck with bolts.
The lawsuit, which seeks more than $50,000 in damages, alleges that the deck was held in place only with nails. After the collapse, Cary officials inspected 85 other decks in the neighborhood built by Town and Country Homes. One other deck, on the home next door to Costello’s, was found to be missing lag bolts connecting it to the ledger board, Village Administrator Cameron Davis said.
A scheduling conference for the lawsuit has been set for Sept. 22.
