Indicted sergeant being paid for accrued time

WOODSTOCK – A McHenry County Sheriff’s Office sergeant facing predatory criminal sexual assault charges is being paid while on administrative leave through time accrued during his tenure.

Gregory Pyle was indicted in January on 10 counts of predatory criminal assault of a child. The 36-year-old sergeant is accused of sexually abusing a minor who is related to him over a four-year span.

He was was relieved of his law enforcement duties and placed on administrative leave shortly after his arrest.

Pyle has been receiving pay for benefit time earned during his more than 10 years with the department, according to Sheriff Keith Nygren. That includes unused vacation and sick and personal days.

“Any employee who has accrued time is entitled to it,” Nygren said. “(Greg Pyle) never used any of his time off and even if we fired him, this is money he has earned.”

That benefit time is expected to dry up sometime this fall, at which time the Merit Commission will meet to discuss disciplinary action.

“We can’t just cut somebody off,” Nygren said. “When his benefit time is gone, that will be the appropriate time to take action through the Merit Commission.”

Pyle had been the head of the evidence division since June 2010.

Pyle's defense attorneys filed a motion May 25 to dismiss all counts based on language in the indictment, according to court records.

The indictment is “merely a recitation of an ambiguous series of acts with an indefinite period of time as opposed to specific allegations of individualized acts of misconduct,” the motion states. “In order to pass constitutional muster, an indictment must state all the elements of the charged offense, inform the accused the nature of the charge so that a defense can be prepared, and specify the charged conduct so that a double jeopardy bar may be raised.”

The case was continued Thursday to July 26, at which time the motion will be discussed and a trial date may be set.
