Court: the sex may be legal, but pictures aren't
SPRINGFIELD – The Illinois Supreme Court says a grown man didn't break the law by having sex with a 17-year-old girl, but he did when he took pictures of the act.
The court said Thursday that the pictures are child pornography.
The ruling comes in a Stephenson County case involving a man named Marshall Hollins. He admitted having sex with a girl under age 18 and taking pictures with his cell phone. He was sentenced to 8 years in prison.
The high court says the law allows someone age 17 to give legal consent to sex, but the person is still a minor. That means pictures are child porn.
Two justices dissented. They say the pictures don't show an illegal act, so they aren't illegal.
