ST. CHARLES – A Bartlett man was sentenced to 10 years in prison in the death of a 10-year-old boy in a boating accident.
Kane County Judge Clint Hull said he believed David Hatyina when he apologized during his sentencing hearing for the pain he caused Tony Borcia’s family. Hatyina promised he would never use drugs or alcohol again.
Hatyina's girlfriend, Renee Melbourn, testified he cries "every single day."
However, Hull on Friday handed the 51-year-old Hatyina a prison term that is four years less than the maximum.
Tony was riding on an inner tube pulled by a boat on Petite Lake in July when he fell out and was struck by a boat operated by Hatyina.
Hatyina pleaded guilty to aggravated driving under the influence of drugs and alcohol.
