Frozen sperm lost in lab failure, lawsuits claim

CHICAGO (AP) — Forty men at risk of infertility because of disease or medical treatments are suing a Chicago hospital. They claim their frozen sperm was destroyed when a lab's storage system failed.

The Chicago law firm of Corboy and Demetrio filed 40 separate lawsuits Tuesday in Cook County Circuit Court. Attorney Matthew Jenkins says the men suffered "profound losses." He says they hoped to preserve their chances for fathering biological children by storing sperm samples.

The lawsuits claim Northwestern Memorial Hospital and Northwestern Medical Faculty Foundation failed to monitor the cryopreservation system where samples were stored. The lawsuit says that system failed in April 2012.

The lawsuit says Northwestern put the samples into one tank when numerous other tanks were available.

Messages left for a Northwestern Memorial Hospital spokeswoman weren't immediately returned.
