McHenry man gets 8 years for 7th DUI

WOODSTOCK – A McHenry man was sentenced Friday to eight years in prison for his seventh DUI.

Ishmael G. Luna, 52, was charged with aggravated driving under the influence on Feb. 25, 2012. He previously pleaded guilty before McHenry County Judge Sharon Prather.
Assistant State's Attorney Dave Johnston said that Luna was driving with an open bottle of Jack Daniel's in the car's center console when Algonquin Police arrested him.

The arrest was precipitated by a minor traffic crash in which no one was injured. Luna's blood-alcohol content was 0.23.

Luna urinated on himself, had trouble standing and had glossy eyes at the time of his arrest, Johnston said, adding that the man faked a diabetic attack and later laughed about it.

"I have no doubt he's capable of being a decent person when's he's not driving drunk," Johnston said. "When he's driving drunk, he's a menace to society."

Any signs of Luna's past irreverence were not present at Friday's sentencing, when his defense attorney, Mark Facchini, called numerous family and friends who each indicated that Luna was a hardworking family man. He since has completed Alcoholics Anonymous and leads a group. He has steady employment and provides support for a large family.

But Prather couldn't look past Luna's past convictions.

"It's very apparent to the court that you're a good man … with a very bad problem," Prather said.

In a shaking voice, Luna apologized, saying he was ashamed.

The judge also ordered Luna to pay a $1,000 fine.
