Jose A. Gaivan, 26, of Elk Grove Village and Juan C. Martinez, 23, of Rosemont, were each charged with a Class X felony of unlawful delivery of a controlled substance and a Class 1 felony of unlawful possession of a controlled substance. The most serious charge carries a potential prison term of up to 30 years.

The charges against the individuals listed are not a proof of guilt. A defendant is presumed innocent and is entitled to a fair trial in which it is the state’s burden to prove his or her guilt beyond a reasonable doubt.
