Geneva attorney D.J. Tegeler won the election over Associate Kane County Judge Marmarie Kostelny by seven votes, according to the last of unofficial voting results released Tuesday.
Tegeler and Kostelny were both seeking a vacancy that will be left by Judge Karen Simpson, who plans to retire Oct. 6. Associate judges are appointed, circuit judges are elected.
The last votes tallied by the Kane County Clerk and the Aurora Election Commission give Tegeler 6,220 votes to Kostelny’s 6,213 in unofficial results.
Normally, the last counted votes will go to the Kane County Clerk on April 7 for its final canvass on April 8, said Linda Fechner, excutive director of the Aurora Election Commission.
But because it is a judicial race, Fechner said after the results go to Kane County
for canvassing, they will then go to the Illinois State Board of Elections on April 18 before they will be declared official.
Fechner said the unsuccessful candidate has five days to challenge the results.
“I’m humbled,” Tegeler said. “I have to thank my supporters and hers also. It truly shows that every vote does count and we should take the process seriously.”
Kostelny did not return a voicemail message seeking comment.
