Eduardo Jose Figueroa-Martinez, 20, of the 4400 block of West Ramble Road, McHenry, faces charges for aggravated driving under the influence of alcohol in a fatal crash after the car he was driving struck a pole early Tuesday, causing his passenger to be ejected, according to a news release from the McHenry Police Department issued late Friday.
Figueroa-Martinez was taken into custody without incident just before 5:50 p.m. Friday after he was released from the hospital, police said.
McHenry police responded just after 12:25 a.m. Tuesday to the 6900 block of Route 120, between Martin Road and East Wonder Lake roads, for a reported single-vehicle crash.
When crews arrived, they found that a 2013 Ford Fusion that had been traveling west on Route 120 left the road and struck a utility pole. It was not clear if either Figueroa-Martinez or his passenger, Jose Luis Ortiz Reyes, 22, of Wonder Lake, were wearing seat belts at the time of the crash.
Ortiz Reyes was ejected from the vehicle, McHenry Fire Battalion Chief Dave Harwood said.
Both Figueroa-Martinez and Ortiz Reyes were taken to Centegra Hospital – McHenry, where Ortiz Reyes was later pronounced dead. Autopsy results revealed Ortiz Reyes died from blunt force trauma to the chest and abdomen, McHenry County Coroner Anne Majewski said.
Figueroa-Martinez suffered injuries that were not considered to be life-threatening.
A Major Crash Assistance Team made up of officers from the McHenry Police Department, Johnsburg Police Department, Spring Grove Police Department and Woodstock Police Department blocked off the roadway to conduct an investigation until roughly 4:40 a.m. Tuesday.
Figueroa-Martinez also was charged with aggravated DUI without a valid driver’s license.
If convicted of the most serious charge, a Class 2 felony, he typically faces three to seven years in prison. However, the sentence can be enhanced in some cases.
Figueroa-Martinez remained in the McHenry County jail Saturday morning, according to the McHenry County Sheriff’s Office’s website.
He did not yet have a bond amount listed Saturday morning.
