A Lake in the Hills man remained at the McHenry County Jail on Friday evening on charges that allege he planned to sell Xanax pills and marijuana.

McHenry County sheriff’s deputies arrested 24-year-old Andrew M. Gagliano early Thursday after finding him in possession of several kinds of drugs and paraphernalia, according to a criminal complaint filed in McHenry County court.

Gagliano, of the 1100 block of Heartland Gate, is accused of possessing
130 Xanax pills, less than 1 gram of ecstasy and between 10 and 30 grams of marijuana when police arrested him, the complaint stated.

He is charged with possession of a controlled substance, possession with intent to deliver marijuana, possession of drug paraphernalia and possession of marijuana.

If Gagliano were convicted of the most serious charge, possession of a controlled substance, he could be sentenced to as many as five years in prison.

At the time of his arrest, Gagliano was on probation for separate 2018 convictions of identity theft and making a false report to a public agency, records show.

His bond is set at $40,000, meaning he would need to post $4,000 to be released from the McHenry County Jail.

Gagliano is due back in court Sept. 6.
