Man sentenced to 6 months for giving judge middle finger

WOODSTOCK – A 24-year-old homeless Crystal Lake man accused of hitting a pregnant woman was sentenced to six months in jail Saturday for gesturing with his middle finger in court.

Kane E. Kellett used profane language and made the gesture in court Saturday morning when asked to raise his right hand, court documents show. Judge Gerald Zopp found him in contempt of court and also ordered that Kellett’s sentence not be reduced through day-for-day good time credit.

Kellett, who had been listed 10th on McHenry County Sheriff Office’s Most Wanted list, was arrested about 10 p.m. Friday on warrants stemming from two incidents involving the same alleged victims.

About 10 p.m. Oct. 13, Kellett allegedly punched a 21-year-old pregnant woman in the face and kicked her in the rib cage in an apartment in the 100 block of West Woodstock Street in Crystal Lake, police said. He also is accused of striking a 23-year-old man in the face that day.

About 8:42 p.m. the next day, Kellett forced his way into the same apartment, repeatedly swung at the man with a blunt object and fled when he learned police had been called, police said. Crystal Lake Deputy Police Chief Dennis Harris said Kellett was an acquaintance of the two alleged victims.

When Crystal Lake police, along with U.S. marshals and sheriff’s deputies, arrested Kellett on Friday, they also found less than 15 grams of heroin and a hypodermic needle or syringe in his possession.

He is charged with home invasion, aggravated battery of a pregnant person, battery, aggravated assault, two counts of resisting a peace officer, possession of a controlled substance and possession of a hypodermic needle or syringe.

If convicted of the most serious charge, home invasion, he could be sentenced to between six and 30 years in prison.

He is next due in court Friday.
