A 51-year-old Chicago man will serve six years in prison for his third driving under the influence conviction. Ben Smart, who has two prior DUI convictions out of Cook County, accepted an offer from the McHenry County State’s Attorney’s Office on Friday and pleaded guilty to aggravated driving under the influence of alcohol.
In exchange for Smart’s guilty plea, McHenry County Judge Sharon Prather sentenced the man to six years in prison and prosecutors agreed to dismiss additional charges, including aggravated DUI with a suspended or revoked license.
The charges stemmed from an April 15, 2018, traffic stop conducted by the McHenry County Sheriff’s Office, according to a news release from the State’s Attorney’s Office.
Smart will serve the prison sentence alongside a separate six-year sentence for an aggravated DUI conviction out of Cook County, according to the release.
He also must pay $1,778 in court costs, public records show.
